Filed for divorce almost 3 years ago but nothing?

My older brother and his (ex) filed for uncontested divorce in 06 along with seperation in Georgia. He didn't receive a notice from the court for a hearing till January 07 and when he went to court his wife didnt show up but judge said their financial affidavit and custody (they have a daughter)had not been filed and he would have granted the divorce that day had it been filed. So he gave them an extension. Well, his wife has never filed her financial affidavit. So he went and filed his own and finally got a lawyer in 08 and his lawyer filed a countersuite against her. That was in the summer of last year. Since then nothing has happened. Can he petition the court for a hearing? What can he do to move things along. He's having a hard time communicating with his lawyer because his lawyer is never in the office so he went to the courthouse to find out the status of his case and the clerk said the last thing she has is when the countersuite was filed and nothing after that.
